WARRANTY

In Kelly Harvey Living’s Limited Warranty, “lifetime” is defined by the life of the original cover. Recovering the frame voids all warranties because in recovering, some or all components may be changed.  This warranty applies under normal, non-commercial use and terminates in the event that the product is transferred to the original retail purchaser to another party.  Improper cleaning voids any warranty.  This warranty does not cover damage as a result of misuse, abuse, accident, commercial use, institutional use, or shipping damage. Because of the craftsmanship involved and the natural materials used in the manufacturing process, minor variances will occur from piece to piece. Therefore, this warranty does not cover such minor differences between your furniture and floor samples, printed illustrations and/or video or internet displays. This warranty does not cover floor samples or products designated “AS IS” at time of purchase.

All warranty periods begin on the date that your furniture is initially shipped to the Kelly Harvey Living Authorized Dealer. For 12 months from the date of purchase, all finishes, parts, and components of new furniture are warranted by Kelly Harvey Living. to the original consumer and are to be free of flawed material and manufacturing defects as set out herein and subject to the provisions, limitations, and exclusions within this Warranty.

Under this Warranty, Kelly Harvey Living’s liability is limited to replace and/or repair the defective component. Kelly Harvey Living’s first intends to supply replacement parts to remedy the defect and if this is not applicable, then the defective product may be replaced or repaired at our discretion. Kelly Harvey Living will not be held responsible for costs to transport the defective products for customers outside of the Greater Toronto Area. This Warranty provides coverage to the original purchaser only and is not transferable under any circumstances. This Warranty covers defects only when used under normal residential conditions and it does not apply to furniture used in a rental, business, commercial, institutional, or any other non-residential setting.

This Warranty does not apply to any condition or damage which is not a defect, including damage resulting from neglect, misuse, abuse, accident, unintended use, incorrect or inadequate maintenance.

Any damage resulting from improper maintenance and care may relate to any of the following:

  • Cleaning using alcohol, water, any cleaning substance
  • Liquid/water damage
  • Improper exposure to sunlight or household humidity
  • Incorrect application of chemical treatment or any protective coating applied by the retailer or the consumer

A claim under this Warranty must be made within the Warranty period in order to be honoured. If defects are acknowledged, it is the consumer’s responsibility to contact us appropriately and to inform the defects to be addressed.

This warranty is exclusive and contains all expressed and implied warranty rights of the purchaser. Kelly Harvey Living makes no other warranty of any kind, expressed or implied. Any implied warranties of merchantability or fitness for a particular purpose, which exceed the obligations or time limits stated in this warranty, are hereby disclaimed by Kelly Harvey Living and excluded from this warranty.

The purchaser and Kelly Harvey Living expressly agree that the sole remedy of the replacement or repair of the defective product or component thereof is the sole remedy of the purchaser. Kelly Harvey Living makes no other representation or warranty of any kind. In no event shall Kelly Harvey Living be liable for any incidental or consequential damages, including but not limited to, loss related to property other than the products, personal injury, loss of use and time, inconvenience or other economic loss.

FURNITURE ANATOMY

FRAMES AND SPRINGS

Kelly Harvey Living warrants to you, the original retail purchaser, protection against manufacturing defects of frames and springs. This warranty applies for the lifetime of the product as long as the product remains upholstered in the original fabric and is used under common wear and conditions.

FOAM CUSHIONS

Kelly Harvey Living warrants to you, the original retail purchaser, protection against abnormal loss of resiliency of the upholstered furniture, for 5 (five) years. Abnormal wear and loss of resiliency should not be confused with softening and flattening of the foam and fibers, which are considered as characteristics of normal wear and not defects.

BLENDOWN CUSHIONS

Kelly Harvey Living warrants to you, the original retail purchaser, protection against loss of resiliency of filling materials for twelve (12) months. Compressing of polyester with use is not considered a loss of resiliency. Your upholstered furniture requires regular “fluffing up” as any upholstered furniture should be maintained with use.

FABRIC MATERIAL

Fabric materials warranted only to the extent of the warranty provided to Kelly Harvey Living by its fabric suppliers. Since manufacturers of upholstery fabrics do not guarantee their products for wearing quality, color-fastness, shrinkage, wrinkling and stretching, those properties are not covered under this warranty.

Blendown cushions will, by design, flatten, wrinkle and soften. We suggest you fluff these cushions as you would fluff the feather or down pillow you sleep on. Blendown cushions are encased in a feather-proof cover (ticking). However, it is typical that feathers will poke through from time-to-time. This is considered normal performance and is not a defect.

LEATHER MATERIAL

Since leather manufacturers do not guarantee their products for wearing quality, color-fastness, shrinkage, wrinkling and stretching, those properties are not covered under this warranty. Because leather is a natural material, every hide is unique and enhanced by natural features. Color variations are normally presented within this type of material as no two hides are perfectly alike but are uniquely different.

The following characteristics should not be seen as flaws in the material as they are accepted as natural qualities of the material:

  • Wrinkles
  • Scratches
  • Insect Bites
  • Healed Scars
  • Other Natural Markings

This warranty does not cover the application of fabric protectors that are not applied by the fabric manufacturer as they may result in the following:

  • Latex Deterioration
  • Seam Slippage
  • Discoloration
  • Damage to Filler Materials

PARTS, REPAIR OR REPLACEMENT

You must advise the after-sales department of any merchandise received damaged and/or inadequate by fax or email within 10 business days of receiving the item/s. The after-sales department may request pictures of the defective merchandise in order to evaluate the damages. Within the warranty parameters, one of three procedures will be processed as outlined below. If the damage is not covered under the warranty, then a quotation will be provided to the customer for the required parts, repair or replacement of the merchandise.

Upon receipt of the pictures the after sales service will then analyze the request and inform the customer of the decision, which will be one of the following:

  • PARTS | Parts will be provided to the customer in order to replace the defective components
  • REPAIR | An authorization number will be issued by the after-sales service but in certain circumstances may request a quotation from a furniture repair doctor
  • REPLACEMENT | We will exchange the product in its entirety
  • RETURN | Return for repair (25% restocking fee will apply)
